“MYSTERY BAG OF SWAG” GIVEAWAY

1. NO PURCHASE NECESSARY: HOW TO ENTER: The Giveaway begins on June 1, 2009 and ends at 5pm EST on (i) the day that Rush HD’s Facebook Fan Page receives 2,000 fans or (ii) December 1, 2009, whichever occurs first. To enter, visit Rush HD’s web site at HYPERLINK “http://www.fuse.tv” www.rushhd.com and follow the on-screen instructions. By entering, entrants agree to be bound by and acknowledge compliance with these official rules including eligibility requirements. Limit one entry per person. Responsibility for receipt of entry rests solely with the entrant. All entries become the property of the sponsor, Rush HD Company LLC. Sponsor will not be responsible for late, lost, or misdirected entries or any error, omission, interruption, dilution, defect or delay in operation or transmission on the Internet or any damage to a user’s computer. If, for any reason, the sweepstakes is not capable of running as planned for any reason which sponsor, in its sole opinion, deem could corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, Sponsor reserves the right to terminate, modify or suspend this sweepstakes, in whole or in part. Sponsor will not acknowledge receipt of entries.
2. ELIGIBILITY: The sweepstakes is open to persons who are 13 years or older at time of entry and are a legal resident of the continental United States. Employees (and their immediate families) of sponsor or any of sponsor’s affiliates, subsidiaries, participating vendors, promotion or advertising agencies, or any other company involved with the design, production, execution or distribution of the sweepstakes are ineligible to enter the sweepstakes. This offer is void where prohibited and subject to all federal, state and local laws and regulations.
3. PRIZE DRAWING: One (1) Grand Prize winner and nine (9) Runner-Up Prize winners will be selected by the sponsor in a random drawing on or about seven days after the end of the sweepstakes (but no later than December 15, 2009), from among all eligible entries received. All entries received by 5pm EST on the day Rush HD reaches the 2,000 fan milestone or December 1, 2009 will be considered valid entries. Odds of winning a prize depend on the number of eligible entries received. All decisions of the sponsor are final and binding on all matters relating to this sweepstakes.
4. PRIZES: One (1) Grand Prize winner will receive the Rush HD “Super Bag of Swag” that includes: (i) one (1) Solar Powered Backpack and assorted promotional swag. Approximate retail value of the Grand Prize is $300. Nine (9) Runner-up prize winners will each receive a Rush HD “Mystery Bag of Swag” that includes: (i) assorted promotional swag. Approximate retail value of each Runner-up Prize is $60. Sponsor reserves the right to substitute a prize of equal or greater value. Prizes cannot be assigned, transferred, changed, or redeemed for cash except at the sole discretion of the sponsor. Any unclaimed and/or unused portion of prize package will be forfeited and will not be substituted. Sponsor responsible only for prize delivery; not responsible for prize utility, quality or otherwise. All federal, state, and local taxes, and all other expenses not specifically mentioned herein are the sole responsibility of the winner. Other restrictions may apply.
5. WINNER NOTIFICATION: Prize winners will be notified via e-mail or Facebook on or about seven days after the end of the sweepstakes (but no later than December 15, 2009). By accepting any prize, winners consent to the use of their names, voices, and likenesses for promotional, advertising, publicity or trade purposes in any and all media worldwide in perpetuity by sponsor without further compensation unless otherwise prohibited by law. Void where prohibited by law.
6. CONDITIONS: By participating in this sweepstakes, entrants and winner release sponsor and its owners (direct or indirect), parents, members, stockholders, affiliates, subsidiaries, directors, officers, agents, employees, advertising agencies, and all others associated with the development and execution of this sweepstakes from and against any and all liability with respect to or in any way arising from this sweepstakes and/or acceptance or use of any prize, including, without limitation, liability for personal injury, damages or loss.
7. WINNERS NAME: To obtain the name of the winner, send a self-addressed, stamped envelope marked “Winners Name” by December 31, 2009 to: “RUSH HD GIVEAWAY” c/o RUSH HD, 11 Penn Plaza, New York, NY 10001, USA.
